1. Agreement to Terms

Welcome to VVD ("we," "our," "us," or the "Company"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you and VVD regarding your use of our world-building platform and related services (collectively, the "Service").

By accessing or using VVD, you agree to be bound by these Terms. If you disagree with any part of these Terms, you do not have permission to access the Service.

2. Eligibility

To use VVD, you must:

• Be at least 13 years old
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the Service under applicable laws
• Not have been previously banned from the Service

If you're using VVD on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscriptions and Billing

Subscription Plans:

• Free: 1 world, 20 cards, 20 images
• Hobbyist ($5/month): 3 worlds, unlimited cards, 1GB images
• Pro ($15/month): Unlimited worlds, unlimited cards, unlimited images*

Billing Terms:

• Subscriptions automatically renew monthly unless cancelled
• Payment is due at the beginning of each billing cycle
• We use Stripe for secure payment processing
• Prices may change with 30 days' notice
• You can cancel anytime; access continues until period ends

Refund Policy:

We generally don't offer refunds. However, we may provide refunds at our discretion for technical issues or billing errors. Contact hi@vvd.sh within 7 days of the charge.

5. User Content

Your Rights:

You retain all rights to the content you create on VVD ("User Content"). This includes worlds, stories, characters, and any other creative works you produce using our Service.

License to VVD:

By uploading User Content, you grant VVD a worldwide, non-exclusive, royalty-free license to:

• Host, store, and backup your content
• Display content you choose to make public
• Generate thumbnails and optimize media
• Provide the Service and its features to you

This license ends when you delete your content or account, except for content you've shared publicly which may be cached or archived.

Content Responsibilities:

You're solely responsible for your User Content. You represent that:

• You own or have rights to use all content you upload
• Your content doesn't infringe any third-party rights
• Your content complies with all applicable laws

6. Prohibited Content and Conduct

You agree not to upload, post, or transmit content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains hate speech or discriminatory content
• Is sexually explicit or pornographic
• Infringes intellectual property rights
• Contains malware, viruses, or harmful code
• Impersonates others or is fraudulent
• Violates privacy rights of others
• Promotes illegal activities or violence

You also agree not to:

• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Bypass any access restrictions or limits
• Scrape or harvest data without permission
• Use the Service for commercial spam
• Resell or redistribute the Service without authorization

7. Intellectual Property Rights

VVD's Property:

The Service, including its design, features, and functionality, is owned by VVD and protected by intellectual property laws. This includes:

• The VVD platform and software
• Our logos, trademarks, and branding
• Website design and user interface
• Documentation and marketing materials

Limited License:

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal or internal business purposes in accordance with these Terms.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using VVD, you agree to our data practices as described in the Privacy Policy.

9. Third-Party Services

VVD integrates with third-party services (like Stripe for payments, OAuth providers for authentication). Your use of these services is subject to their respective terms and policies. We're not responsible for third-party services' practices or content.

10. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We specifically disclaim warranties of:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free service
• Security or accuracy of the Service
• Results obtained from using the Service

We don't warrant that defects will be corrected or that the Service is free of viruses or harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VVD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes damages for:

• Loss of profits, revenue, or data
• Service interruptions or downtime
• Unauthorized access to your account
• Errors or inaccuracies in the Service
• Personal injury or property damage

Our total liability shall not exceed the amount you paid us in the past 12 months or $100, whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless VVD, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws

13. Termination

These Terms remain in effect until terminated by either party.

Your Right to Terminate:

You may terminate by closing your account and discontinuing use of the Service.

Our Right to Terminate:

We may suspend or terminate your account immediately for:

• Violation of these Terms
• Conduct harmful to other users or the Service
• Extended periods of inactivity
• Request by law enforcement

Effect of Termination:

Upon termination, your right to use the Service ceases. We may delete your account and content after a reasonable period. Sections that by their nature should survive termination will remain in effect.

14. Modifications to Service and Terms

We reserve the right to:

• Modify or discontinue any part of the Service
• Change our pricing or subscription plans
• Update these Terms at any time

For material changes to the Terms, we'll provide notice via email or the Service. Continued use after changes constitutes acceptance of the new Terms.

15. Dispute Resolution

Informal Resolution:

Before filing a claim, you agree to try to resolve disputes informally by contacting hi@vvd.sh. We'll attempt to resolve disputes informally for 30 days.

Binding Arbitration:

If informal resolution fails, disputes will be resolved through binding arbitration, except where prohibited by law. You waive the right to jury trials and class actions.

16. General Provisions

Governing Law:

These Terms are governed by the laws of Delaware, USA, without regard to conflict of law principles.

Entire Agreement:

These Terms, along with our Privacy Policy, constitute the entire agreement between you and VVD.

Severability:

If any provision is found unenforceable, the remaining provisions will continue in effect.

Waiver:

Failure to enforce any right or provision doesn't constitute a waiver of that right.

Assignment:

You may not assign these Terms without our consent. We may assign our rights to any successor.
